We are committed to safeguarding the privacy of our website visitors and customers; in this policy we explain how we will handle your personal data.

The source of the usage data are our analytics tracking systems. This usage data may be processed for the purposes of analysing the use of the website and services. The legal basis for this processing is consent and our legitimate interests, namely monitoring and improving our website and services.

We may process your account data (“account data“). The account data may include your name, product, billing address, phone number, company name and email address. The source of the account data is you when registering and/or buying our products or services. The account data may be processed for the purposes of meeting legal (tax) requirements, providing our services, ensuring the security of our website and services and communicating with you. The legal basis for this processing is the performance of a contract, by accepting our terms and conditions, between you and us and/or taking steps, at your request, to enter into such a contract.

We may process information relating to our customer relationships, including customer contact information (“customer relationship data“). The customer relationship data may include your name, your contact details, your products, your response surveys, your IP address and information contained in communications between us and you. This processing includes using your contact details and information about how you use our services to send promotional communications that may be of specific interest to you, including by email. The source of the customer relationship data is you. The customer relationship data may be processed for the purposes of managing our relationships with customers, communicating with customers, keeping records of those communications and promoting our products and services to customers. The legal basis for this processing is consent, our legitimate interests, namely the proper management of our customer relationships, or the performance of a contract between you and us, by accepting our terms and conditions. We do not collect your health & fitness data, sensitive information including racial or ethnic data, sexual orientation, disability, religious, or biometric data.We do not collect contact information in your phone or address book.

We do not collect your user content data, including emails or text messages, photos or videos, audio data, or gameplay content. We do not collect your browsing or search history.

We may process information relating to transactions, including purchases of goods and services, that you enter into with us and/or through our website (“transaction data“). The transaction data may include your contact details, your card details, shipping details and the transaction details. The transaction data may be processed for the purpose of supplying the purchased goods and services and keeping proper records of those transactions. We process credit card payments through a third-party processor and do not hold or store any credit card information on our server. The legal basis for this processing is the performance of a contract between you and us, by accepting our terms and conditions, or meeting legal (tax) requirements.

We may process information contained in or relating to any communication that you send to us, including information contained in any inquiry you submit to us regarding goods and/or services, (“correspondence data“). The correspondence data may include your name, email address, the communication content and metadata associated with the communication when using the website contact forms. The correspondence data may be processed for the purposes of communicating with you and record-keeping, including to resolve any issues you may encounter, to respond to your requests for assistance and to improve our services. The legal basis for this processing is consent OR the performance of a contract between you and us by accepting our terms and conditions.

We may process location “tracking data”, which may include name, vessel and GPS location (coordinates). The source of this data is you. This data may be processed for providing you a public page with your coordinates or to enable a chat services. The legal basis for this processing is the performance of a contract between you and us, by accepting our terms and conditions, and/or taking steps, at your request, to enter into such a contract.


3. Marketing

We may send you information about our services which may be of interest to you. If you have consented to receive marketing, you may opt out at any point as set out below. You have a right at any time to stop us from contacting you for marketing purposes. To opt out please contact us as described in section 14.


4. Providing your personal data to others

We share with the following companies some of your data to maintain and improve our website, to get a better understanding of visitor and customer profiles and ultimately to deliver a better experience insofar as reasonably necessary for the in section 2 specified purposes. These companies are:

  • Google suite, a bundle of collaboration tools for business
  • Google tag manager, used for tracking and analytics on websites
  • Google analytics, web analytics service that tracks and reports website traffic
  • Supabase platform for database management
  • Vercel web hosting
  • Zoho Customer Relationship Management software to more effectively manage our sales and support interactions with you.

Financial transactions relating to our app are handled by through the Apple Apps Store. We will share transaction data with our payment services providers only to the extent necessary for the purposes of processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. To other customers, we may disclose some of your personal data depending on your settings and preferences, such as your location, name, vessel, and vessel instrument metrics if you have opted in to share this information in your mobile application settings.

In addition to the specific disclosures of personal data set out in this section, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defense of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.


5. International transfers of your personal data

For the purpose of providing the services to you, we may transfer, process and store your information outside of your country of residence, to wherever we or our third-party service providers operate.

We have our office in California. The hosting facility for our website is located in Montreal, Canada.

You acknowledge that personal data that you submit for publication through our website or services, such as our news-comments, may be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others.


6. Retaining and deleting personal data

Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. We will retain your personal data as follows:

(a) We retain your account, correspondence, customer relationship and tracking data for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the services. You have the right to the erasure of your personal data without undue delay at any time (as described in section 8).

(b) If your account is deactivated or disabled, some of your data and the content, such as your publication data, you have provided will remain in order to allow other users to make full use of the Services. For example, we continue to display messages you sent to the users that received them and continue to display content you provided.

(c) Transaction (including accounting) data will be retained for a minimum period of 4 years according to California law.


7. Amendments

We may update this policy from time to time by publishing a new version on our website. When we make a material change to this policy, we’ll notify users via email, in-product notice, or another mechanism required by law.


8. Your rights

Our services give you the ability to access and update certain information about you. For example, you can access your profile information from your account. You can update your profile information within your profile settings and modify content that contains information about you using the options associated with that content.

You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you a copy of your personal data. A copy of your data will be subject to a US$49 administration fee.

You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

You have the right to the erasure of your personal data without undue delay, except when processing is necessary for compliance with legal obligations.

You have the right to restrict the processing of your personal data. Where processing has been restricted on this basis, we may continue to store your personal data.

You have the right to object to our processing of your personal data on grounds relating to your particular situation. If you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing.

You have the right to object to our processing of your personal data for direct marketing purposes. If you make such an objection, we will cease to process your personal data for this purpose.

To the extent that the legal basis for our processing of your personal data is:

(a) consent; or

(b) that the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract,

and such processing is carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection.

To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

9. Personal data of children

Our website and services are targeted at persons over the age of 16. If we have reason to believe that we hold personal data of a person under that age in our databases, we will delete that personal data.
